MOLD WAIVER & RELEASE OF LIABILITY AGREEMENT

I, the owner of the vehicle listed above, acknowledge that microbial growth or activity (hereinafter “mold”) or mildew has been detected by either myself or Clarity Car Washing LLC (the “Contractor”), and that such presence is not the result of any action or inaction by the Contractor. I hereby release the Contractor from any and all liability or responsibility to perform or complete mold remediation.

Knowing that I may have an exclusion of coverage for any mold clean up or remediation, AND given the cost of remediation, I hereby decline a full scale remediation for my vehicle and elect to have a treatment of mold spores. This will entail cleaning affected components to remove obvious growths, and treating with various mold spore treatment methods. This will be limited to components that are easily accessible and visibly affected.

I also understand and agree that there may still be mold present in areas affected and unaffected after the clean-up process including but not limited to settled spores and areas of growth that may or may not be visible during the clean-up process. I also understand that this clean-up is not a guarantee against future mold growth in areas affected or unaffected.

Authorized Antimicrobial Agents: I understand that in the best judgment of Contractor, components may be treated with a Commercial antimicrobial agent to inhibit the growth of microorganisms during the drying process. I have received advanced notice of the use of antimicrobial and/or antimicrobial product as part of the restoration process. I understand it is beyond the expertise of Contractor to determine if someone is sensitive to its application and will hold Contractor harmless for its use.

I have read and understand the information above. I Acknowledge and Agree to the Following:

No Guarantee of Complete Mold Removal
This treatment is not a substitute for professional mold remediation. While Sporicidin® may inhibit microbial growth, the Contractor does not guarantee complete removal of mold, prevention of future mold growth, or that treated areas will remain mold-free for any specific duration.

Manufacturer Claims Not Warranted by Contractor
I understand that any claims regarding “residual bacteriostatic activity up to 6 months” are made by the manufacturer of Sporicidin® and not by Clarity Car Washing LLC. The Contractor makes no warranties or representations as to the efficacy, duration, or results of Sporicidin® beyond those made by the manufacturer.

Odor Disclaimer
I understand that while the Contractor will make a reasonable effort to reduce or eliminate odors associated with microbial growth or other contaminants, complete odor removal is not guaranteed. Some odors may persist depending on the severity of contamination, the materials affected, and the condition of the vehicle. I acknowledge that residual odors may remain after treatment and that this service does not constitute a full interior restoration or odor remediation process.

Assumption of Risk
I voluntarily assume all risks associated with the presence of mold and the application of antimicrobial agents, including but not limited to respiratory or allergic reactions, recurrence of microbial growth, or ineffectiveness of treatment.

Hold Harmless Agreement
I hereby release and hold harmless Clarity Car Washing LLC, its owners, employees, and agents from any and all liability, claims, or damages related to:

• The presence of mold before, during, or after treatment
• The application or performance of Sporicidin®
• Any health-related issues arising from mold or the cleaning agents used
• Any loss or damage caused by reoccurring microbial growth after service

Customer Due Diligence
I have been given the opportunity to ask questions regarding this service, and I understand that for full mold remediation, consultation with an environmental or remediation specialist is recommended.
